Semiconductor designs is China's level of technological development, which does not yet permit it to manufacture advanced U. S. Products. However, China's capabilities in the semiconductor sector are rapidly advancing. Therefore, the SIA ta...kes very seriously all issues relating to intellectual property protection in China and strongly supports the efforts of the U. S. Trade Representative over the last few years to negotiate agreements with China to ensure increased enforcement of Chinese patent, copyright and trademark laws.
Of particular concern to the semiconductor industry at present is the fact that compulsory licensing remains authorized under Chinese patent law whenever "necessitated by the public interest. " The WTO Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPs) — to which China is not yet a signatory - prohibits the compulsory licensing of semiconductor technology except in certain limited circumstances.
