That act is validated and confirmed by act of Congress, approved August 6, 1888.
It is evident, however, that the legislation under the said acts authorizing the leas- ing of school lands in Washington Territory contemplates the cultivation and improve- ment and consequent enhancement of the value of such lands. Therefore, in any case where cultivation and improvement of the land are sought, and to that end only the cutting of timber thereon becomes necessary, the same privileges may be accorde...dto the lessees of school lands as are allowed by the circular of this oflice dated Decem- ber 15, 1885 (copy herewith), to homestead or pre-emption claimants who have made 5ona ^e settlements upon public lands. But all cutting not intended and needed to enhance the value, and in excess of the actual requirements for cultivation and improve- ment of the land, or in violation of the conditions and privileges stated in the enclosed circular, renders the party or parties thereto liable to both civil and criminal prosecu- tion.
