Clean Water Act (33U.S.C. §1251,etseq.) To ensure national uniformity in water quality standards, Congress passed the Clean Water Act (CWA) in 1972. This federal law, administered by the U.S. Environmental Protection Agency (EPA), serves as an umbrella law over all state water quality laws.
For the CWA to be effective and enforceable at the state level, the EPA delegated primary implementation of many CWA programs to the state (1974 Cooperative Enforcement Agreement Between
...U.S. EPA and DEQ). Under a new system of partnership between the EPA and the state, greater emphasis is being placed on performance-based evaluations, differential oversight, and greater participation by the state in evaluating performance and determining solutions. In doing so, the focus of EPA oversight is on identifying and solving problems and taking action, where appropriate, in order to deliver more effective and efficient environmental protection. Such an approach necessitates a continuing strong EPA presence, a workable state-EPA relationship, and continuous dialogue and communication between EPA and the state.
