In a recent decision, which I believe is going to be reviewed again in this State, it being rendered originally in Montana, the doctrine of the greatest good to the greatest number was set forth in the clearest possible terms. It was a decision by Judge Hunt in the famous Anaconda smoke case. There was the question of shut...ting down a smelter, which involved the cessation of mining operations and the throwing out of employment of something like twelve thousand men, involving indirectly a 12 population of about forty thousand people. There was no doubt in the world that the surrounding farms were being damaged. At first the injunction was granted, and then the injunction was set aside on the ground that a few could not take away food from so many mouths ; and that was done in entire disregard of ample proof that damage was being done and that the continuance of farming was prejudiced through- out a large range around the smelter.
