No question of contempt can arise until the issue of law is determined ad- versely to the defendant and he refuses to obey the final order of court. In matters of contempt a jury is not required by "due process of law." Prom the very nature of their insti- tution, and that their lawful judgments may be respected and enforced, courts possess power to punish for contempt.
