Suppofing therefore, not granting, that there was not fufficient evidence to convict the Begums either of rebellious actions or defigns, before an ordina...ry court of juftice in ordinary cafes, yet if the fituation of affairs was fuch, that either the public fafety muft be ruined, or feme facrifice or other made for its prefervation, it was the duty of Mr. Haftings to make fuch a facrifice : and if there was an option of facrifcces, it was alfo his duty to fix on that which was the moll effectual for obtaining its end, and which could be made with the leail violation, or appearance of violation, of juftice. But to refume the jaghires (an equi- G 2 valent [ 44 ] valent being intended), and to feize the treafures of the Begums, was the moft effectual facrifice that could be made.
