The Constitution, for example, provides that the judges of the courts of the United States shall hold their offices during good behavior. These the President cannot remove; but most of the officers appointed by him, according to the long established doctrine and prac- tice, whether civil or military, were removable at his pleasure. But Congress, by the act of fifth April, eighteen hundred and sixty-nine, has provided that civil officers, appointed by and with the advice and consent of the Senate, shall not be removed, unless with the like advice and consent.
