Any person, firm, association, company, or corporation making use of the word "trust" in combination or in connec- tion with the word "company, " "corporation, " "incorpora- tion, " "association, " "society, " "organization, " or "syndi- cate, " in the manner hereinabove mentioned, in the transac- tion of business, and not subject to the provisions of this act and the supervision of the superintendent of banks, shall be guilty of a misdemeanor.
No corporation hereafter formed shall use the word... "trust" or "trustee" as a part of its corporate name unless it shall be authorized by its articles of incorporation to act as executor, administrator, guardian, assignee, receiver, depositary or trus- tee; nor shall any corporation hereafter formed accept or execute any trust mentioned in this act, unless it shall have complied with the provisions of this act.
Sec. 105. Every trust company shall invest its capital and trust funds received by it in accordance with the laws relative to the investment of funds deposited with savings banks, unless a specific agreement to the contrary is made between the trust company and the party creating the trust.
