Bendyshe, so far back as 1839, it was contended that the objection was matter of form, and so was aided by sec- tions 25 and 27 of the Statute 1 Wm. IV., c. 61, nevertheless the Court considered the objection fatal. He considered that that case was- an authority, that this was not matter of form, but sub- stance, and accordingly quashed the conviction, on the gi'ound that it expressed one penalty for two offences.
Conviction quashed.

...agistrate has no iurisdiction to try a foreigner for an assault on the hio-li seas on board a foreign ship. The words " any person" and ''wheresoever com- WooD, J. mittcd," in the Statute 12 & 13 Vict., c. 96, s. 1, though general in its terms, apply 1882. only to offences committed by British subjects, or on board British ships. The Statute merely confers on the Criminal Courts of Common law, the jurisdiction Dec, 11. formerly possessed by the Admiralty, but no more : the jurisdiction of the Admir- alty was limited as above.
