As our population ages, the demands on government ifunding will change accordingly. In anticipation of increased numbers of long- term nursing care recipients needing financial help from the state, the 1995 Montana Legislature passed the Lien and Estate Recovery Act. This law allows Medicaid to place and use a lien on real property of Medicaid recipients who meet certain conditions.
The purpose of the act is to restrict consumers from hiding assets in order to qualify for Medicaid. This restric...tion allows Montanans who tfuly need assistance to receive appropriate services. The act also contains a clause which provides public education about lien and estate recovery.
Last year, the DPHHS Senior and Long-Term Care Division was granted $100,000 so a task force could develop and administer these public education programs.
This task force decided the public education programs would include public service announcements (PSAs), educational videos, long- term care brochures and public television broadcasts.
