Gardi- ner, (i) The second was a case which created much popular feeling, involving the question of the exclusion of colored chil- dren from the white schools of Boston Roberts v. Boston, (5 Cush. 206) argued by Charles Sumner and Robert Morris, a young negro lawyer, for the negroes, against Peleg W. Chandler.

... third case was that of the Boston and Lowell R. R. V. Salem and Lowell R. R. (5 Cush. 375), in 1850, involving the question whether the plaintiff had an exclusive right to a railroad between Boston and Lowell. It was one of the most noted cases argued by Joel Parker, Elias Haskett Derby being his associate, arid Charles G. Loring and Benjamin R. Curtis his opponents, (i) An interesting letter from Everett to Chief Justice Shaw Aug. 29, 1848, (Harv. Coll. Archives. Letters of the President), states that Professor Parker had been asked to take part in the case, but desired first to know whether the College would object.
