There are other situa- tions, as Ms. Katzen mentioned, where even though the statute it- self does not appear to require a regulation, the courts for one rea- son or another have forced the agency to do it. My own experience 62 is that in the majority of instances where a regulation is unreason- able, the agency, if it looks hard enough and is willing to think about it hard enough, can find a way to either avoid the regulatory requirement or to make it much less b...urdensome, so that it's not such a problem for the industry.
