The use of an electric transmission facility by a nongovernmental person pursuant to an output contract does not constitute private business use of the facility if: (A) the facility is governmentally owned; (B) the facility is operated by an independent transmission operator in a manner approved by FERC or a state authority; and (C) 52 the facility is not financed for a principal purpose of providing that facility for use by that nongovernmental person.
