Here is an instance which I take from Professor Dicey's work, 1 which shows the nature of the complex maintaining itself where a layman would scarcely expect it. If the ship-owner thinks the in- spector has gone beyond the law or acted in any way informally, he may bring an action against him, and if a jury, probably sympathetic to ship-owners, holds that the law does not bear out what has been done, the action will succeed. Of course such a feature of our system is not necessary with geometrical necessity, but it rests on an implication seen to be inherent by those who understand the complex, and could only be defeated by a special provision of the general law, which could only be made, ex hypothesi, in the public interest.
