" Tliis constitution is a law for rulers as well as people, equally in war and in peace, and covers with the shield of its protection all classes of men, at all times and under all cir- cumstances. [Ex parte Milligan, 4 Wallace, 120, 121. ) I call your attention to the language of this opinion. It clearly holds these propositions: The Vth amendment re- cognized the necessity of an indictment, or presentment, before any one can be held to answer for high crimes^ with the exceptions therein stated; by which it was meant to limit the trial by jury, in this Vlth amendment, to those persons who were subject to indictment or presentment in the Vth: Those connected with the militarv or naval ser- 8 vice are amenable to the jurisdiction which Congress has created for their government, and while thus serving they surrender the right to be tried by the civil courts: All other j>e?*5ons are guaranteed trial hy jury.
