After thefe colonies had revolted againft the autho- rity of Great Britain, France continued uninterruptedly her commerce with them, other than fuch as was contraband, till the 6th of February, 1778, when flie entered into a treaty of amity and commerce, and another of alliance, event- ually to become a treaty ofFenfive and defenfive, with us, un- der the ftyle and charaaer of the thirteen United States In the firft article of the treaty of alliance, France exprefsly aflerts her right to naviga...te, and carry on commerce with the colonies, and declares, that if the Britifh fliould, « in violation of the rights of nations, attempt to hinder that navi- gation and that commerce," {he would make it a common caufe. But to prove unequivocally what was then the opi- nion of France on this fubjea, : will refer to one of her own ftate papers. In the annual regifter for 1778, p. 299, is the note of the French minifter De Noailles, dated London, March 13th, 1778, communicating to the Britifti govern- ment the treaty of amity and commerce entered into be- tween France and thefe ftates, part of which is as follows- « The United States of North America, who are in full pojfejfion of independence, as pronounced by them on the 4th of July, 1776, having propofed to the king to confolidate, by a formal convention, the conneaion begun to be eftablift- cd between the two nations, the refpeaive plenipotentiaries 3 18 Have figned a treaty of friendlhip and commerce, defigned tO' ferve as a foundation for their mutual good correfpondence.
