The first adoption statute was passed in 1881 and several amendments have been made since then. The Con- solidation Act of 1908 provides that a husband and wife jointly, or a married woman alone with the con- sent of her husband, or an unmarried woman alone who is at least 18 years older than the child to be adopted, or an unmarried man at least 40 years older than the child may apply to a magistrate for an order of adoption. The magistrate hears the case in camera, and after taking evidence ma...y sanction the adoption. If the child is over 12, the child's consent is necessary, and the consent of the parents or of the guardian is requisite if the child is not a deserted ADOPTION OF CHILDREN, MARRIAGE 139 child. No premium can be paid to the adopting parent, and on adoption the child for all purposes, civil and criminal and as regards all legal and equit- able interests, liabilities, rights and benefits, privileges and consequences of the natural relation of parent and child, is deemed in law the child born in lawful wedlock of the adopting parent.
