In civil actions for libel, the truth is generally a com- plete defence. The Legislature of Massachusetts qual- ified this rule by a statute passed in 1855, providing that in both civil and criminal proceedings the truth "shall be deemed a suf
...ficient justification, unless mali- cious intention is proved. " In the other States, with possibly one or two exceptions, even if the motive of the writer or publisher of the libel is shown to have been malicious, the truth is, in civil actions, a complete defence. This rule is based upon the just and equi- table principle that a man is not entitled to damages for injury inflicted upon a reputation to which his true character did not entitle him. If a man is a knave and an impostor, the fact that he has succeeded in masquer- ading as an honest man should give him no right to recover damages from one who, even though mali- ciously, exposes his true character.
