We congratulate Members of the Subcommittee for recognizing the ...necessity to in- crease the certainty regarding the intellectual property rights for the biotechnology industry and provide a "level playing field" between domestic and foreign bio- technology competitors. Congress should send a clear message that foreign competi- tors must compete fairly with the United States biotechnology industry.
*It has been asserted by some that the courts will eventually resolve the issue addressed by H. R. 587. It has been over six years since this argument first surfaced and we are still awaiting judicial resolution.
