12. When [whenever] any building in said city shall be pulled down. ^^ g^ j^ shall be the duty, and be lawful for the chief engineer or mayor to order and direct such buildine or any other building which they may deem hazardous and likely to communicate fire to other buildings, or any part of such building, to be pulled down and destroyed, and no action shall be maintained against any person or against the city therefor; but any person inter- ested in any such building so destroyed or injured m...ay, within three months thereafter, apply to the common council to assess and pay the damages he has sustained. At the expiration of the three months if any such application shall have been made in writing, the common council shall either pay the said claim- ant such sum as shall be agreed upon by them and the said claimant for such damages, or if no such agreement shall be effected, shall proceed to ascertain the amount of such damage, and shall provide for the appraisal, assessment, collection and payment of the same, in the same manner as is provided in tlus act for the ascertainment, assessment, collection and pay- ment of damages sustained by the taking of lands for purposes of public improvement.
