This was one of the thirty-six Acts of Assembly passed in 1700, which was disallowed and repealed by the Privy Coun- cil in 1705. The reason given by the Attorney-General for this action is this : " The Proprietary has no such power by his grant [that is, his charter], and I think it not right that he should give it to himself by this Act." prominent Germans who had settled at Germantown, giving as the reason therefor that these people were Protestants who had either sworn to the test and subscribed the Decla- ration, or were ready to do so. In the years 1729, 1730, 1734, and 1737 similar special Acts of naturalization were passed, and the same reasons were given for enacting them.
In 1742 a general Act was passed providing for the natu- ralization of those foreigners who had lived seven years in the Province, who were Protestants, and who showed their Protestantism by their willingness to take the Tests and subscribe the Declaration.
