That H. G. Slocum made formal application for a certificate of public convenience and necessity to operate motor vehicles for hire in the fur- nishing of freight service between Vancouver, Washington and Washougal, Washington, on the 16th day of August, 1921. During the progress of the hearing H. O. Slocum through his attorney requested that the application be treated as amended so as to cover the route extending from Washougal, Washington, to Portland, Oregon, via Vancouver, Washington, and in
...termed- iate points. This request was granted by the department.
II.
That subsequent thereto a formal protest to the issuance of such certificate was filed by Charles W. Smith, who is operating between Portland, Oregon, and Vancouver, and Washougal, Washington, under a certificate of public convenience and necessity issued by this department, based on his good faith opeeration on January 16, 1921, as provided for under Section 111 of the Laws of 1921.
III.
It developed at the hearing that H. O. Slocum commenced the operation of motor busses under his own name and management on March 28, 1921.
