Judge Drummond held that land dedicated to public uses for a par- ticular purpose, could not be diverted by either State or municipal power from that purpose by a grant of such character, and that the United States Government still had title to interfere and restrain the nullification of the rights of the public, and he accordingly granted the injunction prayed for. The opinion of this eminent jurist may be found in Vol. 2, BisseH's U. S. Reports, on page 175.
The General Assembly fully investigated this fraudulent legisla- tion and repealed the act of 1869, by act of April 15, 18T3, but the rail- road company has never ceased to assert its alleged u vested right" under the former grant, thinking that it and time will be, as usual, more than a match for any other power.
