April 2 President Johnson issued his proclamation declaring the end ("except in Texas") of the insurrection which had existed in the seceded Slates, and that it was thenceforward to be so regarded. On the 1st ot May, in an order relating to military courts aud commissions in these States, the President directed that there- after whenever offences committed by civil- ians were to be tried whei'e civil tribunals were in existence which could try them these cases were not authorized to be, and wou
...ld not be, brought before military courts, but would be committed to the proper civil authorities. The result of the Congressional inquiry into the character of the laws and governments of the se- ceding Slates, aud the manner of admin- istering justice there, was to satisfy Con- gress that the governments in those States were illegal or anti republican in form, and that the emancipated race was not afforded the equal protection of the laws with the governing class; that many of the disabili- ties that attached to them when slaves had not been removed, and that in fact in soma districts they had no protection at all, owing to the prejudice of the gov- erning class against them, and the ne- glect of the civil authorities to arrest and punish those who committed the crime of murder or other offences against them.
