In July, 1906, a very important decision was given by the Court of Appeal on the question whether a workman could sue in an ordinary Court for wages fixed by an award of the Arbitration Court. The particulars of the case which gave rise to the judgment are briefly
...as follow: — A firm of printers in Pahiatua were, in 1905, fined £10 by the Arbitration Court for having paid a youth named Reese in their employment less than the rate of wages fixed by an award of the Court. No order was made as to the payment of back wages. Reese had been in the service of his employers since 1898, and had never made any objection to the wages he had received, although these had always been from the time the award was made in 1902, paid less than the award rate. The arrears, it appears, amounted to £51/16/-, and after the employers had been convicted in the Arbitration Court, a claim was made in the Magistrate's Court for the recovery of the amount.
