There should be no Superfund liability for the disposal or transportation of hazardous substances before a date certain (but not earlier than January 1, 1981) or for the ownership or operation of a site contaminated before a date certain (but not earlier than January 1, 1981) except in cases of demonstrated significant harm to the environment and/or public health where the responsible party knew or should have known or that harm or potential harm, or in cases where disposal violated some other legal requirement in existence at the time.
