To each of the five first circuits, three circuit judges were assigned, and an annual salary of two thousand dollars was allowed to each judge. In the sixth circuit, the judicial duties were to be performed by a circuit judge, with the assistance of the district judges of Kentucky and Tennessee. After the circuit judges had been appointed and commissioned, and after they had entered upon the performance of their judicial duties, according to the provisions of the act constituting the circuit courts, in the senate of the United States, on the sixth day of January, 1802, Mr.
