129 compellable to give evidence, except as hereinafter excepted, and the exceptions are to be found in the following sections.
The third section is : " Nothing herein contained shall render any person who in any criminal proceeding is charged with the commission of any indictable offence, or any offence punishable on summary conviction competent or compellable to give evi- dence for or against himself or herself, or shall render any per- son compellable to answer any question tending to crimin...ate himself or herself, or shall in any criminal proceeding render any husband competent or compellable to give evidence for or against his wife, or any wife competent or compellable to , give evidence for or against her husband." And the fourth section is : " Nothing herein contained shall apply to any action, suit, proceeding, or bill in any Court of Common Law or in any Ecclesiastical Court, or iu either House of Parliament, insti- tuted in consequence of adultery or to any action for breach of promise of ma,rriage." Subsequently to the passing of these Acts the Legislature has rendered it competent in the Divorce Court for the husband and the wife, if the suit be instituted in a particular manner, to give evidence in cases of adultery, and in cases of cruelty and impotency their evidence is continually admitted.
