They obtained, however, letters of pardon by King James the Sixth, under the great seal, dated at Falkland, September 1591, for their intercommuning with the Earl of Bothwell, and were admitted to the king's peace. These letters included Buccleuch, Walter Scott of Harden, and Walter Scott of Quhitslaid. 1 The date of the letters of pardon is also the date fixed for the departure abroad of Buccleuch, who, on the 4th September 1591, obtained a licence for that purpose from King James. The letter ...provides that if he should be prevented by wind or weather from taking his passage by sea, or until he received a passport from England, he was to remain within the bounds of Edinburgh or Leith, until he took his departure from the realm, under the penalty of £10,000. Buccleuch had been in that same year appointed keeper of Liddesdale, and, with a view to his departure abroad, he was relieved of the office, to which he was reappointed after his return. The terms of the letter of licence imply that he was sent out of the realm of Scotland on account of his intercommuning with Bothwell.' 2 Letters were granted by the king, dated 7th August 1591, by which he took under his protection, during Buccleuch's residence abroad, his wife and children, and all his lands and possessions, and directing that all actions and causes concerning him should remain in abeyance until forty days after his return.
