What happened (to sketch in large lines) was this. The Spaniard said : " I alone have the right to go beyond the line. Whoever else comes there is a pirate, and as that I will treat him whenever he is caught, unless he comes in war-time with a commission. Then he is a servant of my enemy, and entitled to be treated according to the custom of the wars. In peace he is a pirate. " To this the other Powers replied : " We do not allow your claim, but it is not convenient for us to compel you to give... it up by arms. So we note our protest, v/arn you that we do not hold our subjects forbidden to sail west, to trade with all who will deal with them, and to establish themselves wherever you are not in actual occupation. If you touch them, you do it at your peril. " To their subjects the Governments said : " Go west if you please, but remember that it is for your masters to decide whether you are to be protected or avenged. " The Spaniard and the adventurers accepted the duel on these terms. He thought it better to run the risk of all the harm adventurers could do him, than to concede the principle by acknowledging that foreign Governments might exercise jurisdiction within his bounds.
