Collection of fines for benefit of literary fund- The Su- perintendent of Public Instruction, by and with the advice of the Attorney-General, is authorized to take such steps and employ such attorneys and agents for the collection of fines due the Common- wealth for the benefit of the literary fund as may be deemed neces- sary, the said attorneys and agents to be paid for their services out of actual collections made in each individual case such compensa- tion as may be agreed on in writing: pr...ovided, that no such attor- ney or agent shall be employed to enforce the collection of any fine which has been imposed during the term of office of any attorney for the Commonwealth now in office in the State. When such col- lections are made, the net amounts thereof shall be turned into the treasury of the State to the credit of the literary fund as provided by law, and the Superintendent of Public Instruction, by and with the advice and co-operation of the Attorney-General, is authorized to make such compromise, settlement and adjustment of said fines as may be deemed right and proper and for the best interests of the school funds of the State.
