In the event that any vacancy in the position of third engineer upon said Board shall not be filled by the selection of a third engineer by said City and the Company within thirty (30) days after such vacancy shall arise, then the per- sons then acting as judges of the (main) Appellate Ck>urt for the First District of Illinois, or a majority of them, may fill such vacancy on said Board by ap- pointing a competent engineer thereto upon the application of said City or the Company, after ten days'... written notice having been given to the other party of such application.
In case either the said City or the Company desires the removal of the said third engineer and the appointment of another engineer in his place, the party desiring such removal and new appointment may, upon giving ten (10) days' writ- ten notice thereof to the other party, apply to the said judges for such removal, and the said judges or a majority of them shall within ten (10) days from and after such application set the same for informal and summary public hearing, at which the party desiring the removal shall publicly present its reasons for asking such removal.
