] JUDGES OP THE SUPERIOR COURT. 297 In 1734, he was appointed a special justice of the Court of Common Pleas for Suffolk, and in 1739, was made one of the standing Judges of that court for the county of Es- sex. He held the office of Judge of the Common Pleas until his promotion to the Superior Court.
In 1766, a controversy having arisen between the House of Representatives and the Governor as to the right of the Judges to sit as members of the council, Judge Lynde, who had long been of that bo...dy, declined re-election as coun- sellor, and thus escaped the odium which fell upon other members of the court. He was, in fact, liberal in his po- litical views, and rather inclined to the side of the people.
In 1770, the trials of Captain Preston and the British soldiers who were concerned in what is known as the "Boston Massacre, " came before the Superior Court. It was an occasion of the deepest interest to the province, to the government and the cause of justice. The trial was to take place in the very scene of the event which had roused a whole nation.
